Introduction

These Terms of Service ("Terms") govern your access to and use of AlbumCover.Art, a creative-service platform owned and operated by Mohammed Ezzerrouqi (the "Sole Proprietor"), ("AlbumCover.Art," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old or the age of digital consent in your jurisdiction to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security incident.

Acceptable Use

• Do not violate any applicable laws or regulations.
• Do not infringe, misappropriate, or violate others' rights (including privacy, publicity, and IP).
• Do not upload or generate content that is unlawful, harmful, abusive, harassing, defamatory, hateful, or violent.
• Do not attempt to probe, scan, or test the vulnerability of the Services, or disrupt or circumvent security measures.
• Do not reverse engineer, decompile, or attempt to derive source code from the Services except as permitted by law.
• Do not use the Services to train competing models without our express written consent.

Content and License

You retain ownership of content you submit to the Services. To operate and improve the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and create derivative works of such content solely for the purpose of providing, improving, and securing the Services. You are responsible for ensuring you have all necessary rights to your content.

AI Outputs

Outputs generated by the Services may be novel and are provided "as is" without any guarantee of uniqueness, accuracy, or non-infringement. You are responsible for reviewing outputs for suitability and for complying with applicable laws when using outputs.

Intellectual Property

We and our licensors own all rights, title, and interest in and to the Services, including software, models, features, and branding. Except for the limited rights expressly granted to you, we reserve all rights.

Subscriptions, Billing, and Refunds

Some features require a paid subscription or usage-based fees. By purchasing, you authorize us and our payment processors to charge your payment method for applicable fees and taxes. Subscriptions renew automatically until cancelled in your account settings.

We offer prorated refunds within 7 days of purchase for any unused generations.
If you're not satisfied, contact support and we'll work to find a solution.
Approved refunds are issued to the original payment method within 5–10 business days of approval.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we believe your use poses risk to us or others. Upon termination, provisions that by their nature should survive will survive (including ownership, disclaimers, limitation of liability, and dispute resolution).

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You will indemnify and hold harmless AlbumCover.Art and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

Changes to the Services and Terms

We may modify the Services and these Terms from time to time. If we make material changes, we will provide notice by posting an updated version with a new "Last Updated" date or by other reasonable means. Your continued use of the Services after changes become effective constitutes acceptance of the changes.

Governing Law; Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which AlbumCover.Art operates, without regard to conflict of law principles. Any disputes will be resolved exclusively in competent courts in that jurisdiction, unless otherwise required by law.
